Terms of Service

1. Acceptance of Terms

By accessing or using the S4VOR platform at s4vor.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all users, including diners (customers), restaurant owners, and restaurant staff.

2. About S4VOR

S4VOR ("Find Your Flavor") is a restaurant platform that provides online ordering, digital waitlist, table reservations, customer management, and reporting tools to restaurants. S4VOR is not a delivery service and does not employ drivers. Delivery, where available, is handled by the restaurant's own staff.

3. Accounts

To place orders, join waitlists, make reservations, or access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.

Restaurant owners create a separate account to access the restaurant dashboard. You must have the authority to act on behalf of the restaurant you register.

4. Platform Fee

S4VOR charges diners a platform fee on orders. The current fee is 1.5% of the order subtotal, capped at $1.50 per order. This fee is clearly displayed during checkout before payment is submitted. S4VOR does not charge restaurants any commission, monthly fee, or listing fee for use of the core platform.

S4VOR reserves the right to adjust the platform fee with reasonable notice. Any changes will be communicated to users and displayed at checkout.

5. Orders and Payments

When you place an order through S4VOR, you are placing an order directly with the restaurant. S4VOR facilitates the transaction but is not a party to the sale of food or beverages. All payments are processed by Stripe, a third-party payment processor. By placing an order, you agree to Stripe's terms of service.

Prices, availability, and delivery areas are set by each restaurant. S4VOR does not guarantee accuracy of menu information, pricing, or delivery estimates provided by restaurants.

Refunds and cancellations are handled on a case-by-case basis. If you have an issue with an order, contact us at support@s4vor.com or contact the restaurant directly.

6. Waitlist and Reservations

S4VOR provides digital waitlist and reservation tools. Joining a waitlist or making a reservation does not guarantee a table. Restaurants manage their own availability and may cancel or modify reservations at their discretion. S4VOR is not responsible for wait times, table availability, or restaurant-side cancellations.

7. Restaurant Obligations

Restaurants that list on S4VOR agree to: provide accurate menu information and pricing; fulfill orders in a timely manner; maintain food safety standards in accordance with applicable law; and not use the platform for unlawful purposes.

S4VOR may remove or suspend restaurant listings that violate these Terms, receive consistent negative feedback, or fail to fulfill orders.

8. User Conduct

You agree not to: use the Platform for any unlawful purpose; submit false information, fraudulent orders, or fake reviews; interfere with or disrupt the Platform; attempt to access accounts or data belonging to other users; scrape, crawl, or use automated tools to extract data from the Platform; or harass restaurant staff or other users through the Platform.

9. Reviews

Users may submit reviews of restaurants they have interacted with. Reviews must reflect genuine experiences. S4VOR reserves the right to remove reviews that are abusive, fraudulent, or that violate these Terms. Each user may submit one review per restaurant.

10. Intellectual Property

The S4VOR name, logo, design, and platform software are the property of S4VOR. Restaurant content (menus, photos, descriptions) remains the property of the respective restaurant. You may not reproduce, distribute, or create derivative works from S4VOR's intellectual property without written permission.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. S4VOR does not warrant that the Platform will be uninterrupted, error-free, or secure. S4VOR is not responsible for the quality, safety, or legality of food prepared by restaurants on the Platform.

12. Limitation of Liability

To the fullest extent permitted by law, S4VOR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. S4VOR's total liability shall not exceed the amount you paid to S4VOR in platform fees in the twelve (12) months preceding the claim.

13. Termination

S4VOR may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting support@s4vor.com. Upon termination, your right to use the Platform ceases immediately.

14. Changes to These Terms

S4VOR may update these Terms from time to time. We will notify users of material changes by posting the revised Terms on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
